JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 14-06-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
After going through the allegation attributed by the informant under written report, it is evident that it happens to be a case of cyber crime.
Petitioner's presence in the written report is not at all found, however, his presence has been perceived during course of investigation on account of having his account number actively involved with the alleged crime.
That being so, the learned lower court is directed to procure the details of the amount which, the informant has been deceived and further, on deposit of the aforesaid amount at the end of the petitioner, in case he so desires, petitioner Chandan Kumar, will be released on bail by the learned lower court itself on the
Patna High Court Cr.Misc. No.25235 of 2016 (2) dt.14-06-2016 2/2 satisfaction of the learned lower court relating to Laheriasarai P.S. Case No. 21 of 2013. In case the amount is not deposited at the end of the petitioner, then in that event petitioner will not be entitled to be released on bail.
The aforesaid activity will not cause prejudice to the interest of the petitioner during the course of the trial. With the aforesaid observation, instant petition is disposed of.
