The petitioner is apprehending his arrest in connection with Mahila P.S.Case No31 of 2017 (G.R.No.2556 of 2017) dated 4.7.2017 , registered for offences punishable under Sections 341, 376 of the Indian Penal Code.
Allegation against the petitioner is that he made physical relation with her for eight years and now he has refused to marry her.
Submission of the learned counsel for the petitioner is that the informant is a married girl and falsity of the case will appear from the fact that the FIR has been lodged stating that since eight years, there was relationship with her that shows consensual relationship between the parties.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.1536 of 2019(2) dt.23-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Purnea in connection with Mahila P.S.Case no.31 of 2017 (G.R.No.2556 of 2017), subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case..
With the aforesaid observation, this application is allowed.
