The petitioner seeks bail in connection with S.Tr. No. 761/2010 arising out of Dhanarua P.S. Case No. 151/2001 instituted for the offence under Sections 382, 302/34 of the Indian Penal Code and 27 of the Arms Act pending before the Additional Sessions Judge IX, Patna.
Prayer of the petitioner for bail was earlier refused by this Court vide orders dated 11.03.2010 and 10.07.2013 passed in Cr. Misc. No8398 of 2010 and Cr. Misc. 46232 of 2012. It appears the learned counsel for the Petitioner has not appeared for lack of instructions.
The trial court report dated 09.02.2015, reveals that except the Investigating Officer all witnesses have been examined,
Patna High Court Cr.Misc. No.10649 of 2015 (2) dt.15-04-2015 and hence, I am not inclined to review the earlier order refusing bail to the Petitioner.
Hence, this application is dismissed.
The trial Court is directed to conclude the trial expeditiously if he has not done so already.
