The petitioner apprehends her arrest in Nawada Nagar (Bundelkhand) P.S. case No. 589 of 2018 registered under Section 30(a) of Bihar Prohibition & Excise Act, 2016. The petitioner is owner of the vehicle from which 40.8 liters of country made liquor was recovered. The petitioner was not present at the place of occurrence. The driver of the vehicle misused the vehicle and for that the owner of the vehicle cannot be held responsible. The petitioner is a lady. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be

No.80088 of 2018(2) dt.15-01-2019 2/2 enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cumSpecial Judge, Nawada in connection with Nawada Nagar (Bundelkhand) P.S. case No. 589 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
