JUSTICE SANJAY PRIYA ORAL ORDER 2/ 10-05-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Parwalpur P.S. Case No.206 of 2018 instituted for the offence under Section(s) 302/34 Indian Penal Code.

In the written report, it is alleged that this petitioner with other three accused persons came to the house of the informant and took his son, Bulbul, with them on 26.12.2018 at 7.30 AM. Thereafter, the informant tried to contact his son on mobile at about 9.00 PM, which was found switched off. It is further alleged that on 27.12.2018 at about 11.30 AM the informant heard hullah that one dead body is lying in a ditch in orchard. The informant went there and found dead body of his

Counsel for the petitioner submits that son of the informant was called by this petitioner and other accused and he did not return in the night and on the next day dead body was found.

From submission of counsel of petitioner, it appears that instant case is based on circumstantial evidence. There is no allegation of specific overt act against the petitioner. Petitioner is in custody since 28.12.2018 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 1, Hilsa, Nalanda, in connection with Parwalpur P.S. Case No.206 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
