JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 16.10.2015 passed in Cr. Misc. No.28511 of 2015, on the ground that the petitioner is in custody since 28.04.2015 and only one witness who is the mother of the informant has only been examined who has not supported the prosecution version vide annexure-3 and she has been declared hostile.

Learned APP submits that the trial should be expedited. In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail of the petitioner, at this stage, again his prayer for bail in S. T. No. 297 of 2015 arising out of Bahadurpur P.S. Case No. 250 of 2015

Patna High Court Cr.Misc. No.23164 of 2016 (2) dt.22-06-2016 pending in the court of learned 2nd Additional Sessions Judge, Darbhanga stands rejected.

However, learned trial court is directed to take all positive steps for securing the attendance of rest witnesses so that the trial is concluded as early as possible, preferably within two months from the date receipt/production of a copy of this order. Let a copy of this order be sent to the Superintendent of Police, Darbhanga who is directed to take necessary steps for production of rest witness before the trial court.
