2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 363, 366 and 376 of the Indian Penal Code, registered in connection with Manihari P.S. Case No. 219 of 2023.

3. The allegation against the petitioner is of abducting the daughter of the informant with an intention to marry with her.

4. The learned counsel for the petitioner has submitted that he has been falsely implicated in this case and has committed no offence. He submitted that the victim has been recovered. He further submitted that the victim went with this

No.36110 of 2024(5) dt.19-09-2024 2/2 petitioner out of her own sweet-will and the relationship between them also seems to be consensual but she gave her statement which has been recorded under Section 164 of the Cr.P.C. under pressure of her parents. As per Medical report, it appears that the victim is major girl. Petitioner is in custody since 22.09.2023.

5. Mr. J.N. Thakur, learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I-cum-Special Judge, SC/ST, Katihar in connection with Manihari P.S. Case No. 219 of 2023, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
