The petitioners seek bail in anticipation of their arrest in connection with Birpur P.S. Case No. 61 of 2020, dated 07.06.2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 337, 338, 307, 379 and 324 of the Indian Penal Code. Later on, Section 302 of the I.P.C. was also added.

The petitioners have not been named in the F.I.R., but their names have transpired only during the course of investigation.

No.32462 of 2020(2) dt.12-02-2021 2/2 Learned counsel for the petitioners has submitted that they are the neighbours of the informant and if at all they had participated in the occurrence, they would surely been named in the F.I.R. It has further been submitted that one of the accused persons of this case has been granted bail by a Bench of this Court vide order dated 29.01.2021 in Cr. Misc. No. 32239 of 2020.

Regard being had to the facts afore-stated, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Add. Chief Judicial Magistrate-VI, Begusarai, in connection with Birpur P.S. Case No. 61 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
