The petitioner apprehends his arrest in Sherghati (Dobhi) P.S. Case No.501 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act. The gist of the allegation is that two persons were coming on a motorcycle and the informant, who was on patrolling duty, intercepted the motorcycle. The person, who was driving the motorcycle, namely, Sanoj Kumar was apprehended and Sanoj Kumar was found to have kept a plastic bag from which about 20 litres liquor was recovered. Learned counsel for the petitioner submits that Sanoj Kumar disclosed the name of the person, who managed to flee away.

Having considered the facts and the nature of

Patna High Court Cr.Misc. No.79238 of 2018(2) dt.29-01-2019 2/2 allegation made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Sherghati (Dobhi) P.S. Case No.501 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
