SONI SHRIVASTAVA ORAL ORDER 02-07-2025 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the Vigilance.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 318, 338, 336, 340, 61 (2)/3 (5) of the B.N.S.
3. As per the prosecution case, the petitioner is alleged to have obtained appointment on the post of Panchayat Teacher on the basis of forged and fabricated marks-sheet.
4. It is submitted by learned counsel for the petitioner that the petitioner was appointed as Panchayat Teacher after proper verification of his certificates by the department concerned. However, subsequently, his documents have been declared to be forged and fabricated without giving any notice or

Further, it has been stated in para-6 of the petition that he has already been dismissed from the service after institution of the F.I.R. and the petitioner is aged about 57 years. Petitioner has no criminal antecedent.
5. Learned APP for the State opposed the prayer for bail.

Taking into consideration the facts and circumstances of the case, the nature of the accusation and also the fact that the petitioner had already been terminated from the service, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Rampur Chauram P.S. Case No. 106 of 2024, subject to the condition as laid down under Section 482 (2) Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
