JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-392, 328 of the Indian Penal Code.
Petitioner is not named in the first information report but in course of investigation, his name surfaced in confessional statement of co-accused and after that, he was arrested and made his confessional statement but except the aforesaid material, there appears to be nothing against the petitioner. The petitioner is languishing in jail custody since 29-02-2016 but uptill now, he has not been put on test identification parade nor the looted truck has been recovered from his possession.
Considering the above-said facts and circumstances of
Patna High Court Cr.Misc. No.23185 of 2016 (3) dt.12-07-2016 2/2 the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Daudnagar P.S. Case No. 26 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Daudnagar.
