JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-03-2021 As prayed for, let the learned counsel for the petitioners remove the defect(s), as pointed out by the office vide it's note, dated 08.12.2020, within four weeks of starting of the Court proceeding in physical mode properly. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the state.

The petitioners seek pre-arrest bail in connection with Dighwara P.S. Case No. 30 of 2019, registered under Sections 341, 323, 379, 504, 506, 498A and 34 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act.

The accusation is of torturing of the informant, Rinki Kumari, by her husband and in-laws due to non-fulfillment of demand of cash of Rs.1,50,000/- and Maruti Wagon 'R' and

Patna High Court CR. MISC. No.33490 of 2020(2) dt.16-03-2021 2/2 removing the informant, Rinki Kumari, from matrimonial house on 04.02.2019.

Submission is that petitioners are cousin father-in-law, father-in-law and mother-in-law of the informant, Rinki Kumari, and they have falsely been implicated in this case on false allegation due to misunderstanding in between the informant, Rinki Kumari, and her husband, Indrajeet Ram. Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Dighwara P.S. Case No. 30 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, I, Saran at Chapra, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
