JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2019 This is an application for grant of anticipatory bail in connection with Munger Mahila P.S. Case No. 23 of 2018, disclosing offences under Sections 376, 506, 34 of the Indian Penal Code.

Allegation against the petitioner is of having sexual intercourse with daughter of the informant on the pretext of marriage.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and the medical report does not support the prosecution case. Further, he has no criminal antecedent.

Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the petitioner stating that the petitioner has been declared

Patna High Court Cr.Misc. No.80024 of 2018(3) dt.31-01-2019 2/2 absconder in this case.

Having heard both sides, considering the above facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court, if possible, on the same day.

Accordingly, this application is dismissed.
