The petitioner is languishing in custody since 21.3.2016 in a case registered for the offence punishable under sections 20, 22, 24 of the N.D.P.S.Act.
Prosecution case is that from the Verandah of the petitioner 32 sachets containing Ganja and from the house of the petitioner 22 kgs. Ganja were recovered. It was admitted by the petitioner that the Ganja was brought from Nepal. It is submitted by the learned counsel for the petitioner that the recovery has been made from the joint family house and the weight has been recorded on speculation. Patna High Court Cr.Misc. No.23071 of 2016 (3) dt.24-06-2016 granted bail by the learned court below.
Considering the recovery of commercial quantity of Ganja, this Court is not inclined to grant bail to the petitioner in connection with Singheshwar (Madhepura) P.S.Case No. 62/2016 (Special Case No. 2/2016) pending in the court of Sessions Judge, Madhepura.
This application is, accordingly, rejected.
