The petitioner apprehends his arrest in Complaint case No. 01/2017 for the offences allegedly committed by the petitioner under Section 406, 420 of the IPC. The gist of the allegation is that petitioner purchased bricks from the brick kiln of the complainant and issued cheque of Rs. one lac for supply of 16,000/- bricks. When the complainant presented the cheque for encashment the cheque was returned on account of insufficiency of fund in the account of petitioner.

The learned counsel for the petitioner submits that petitioner paid cash for purchasing bricks from the brick kiln of

Patna High Court CR. MISC. No.31013 of 2019(2) dt.10-05-2019 2/2 complainant. The petitioner is still ready to repay the price of bricks of the complainant.

Taking into consideration the facts that the dispute requires rendition of accounts for supply of bricks and receipt of money paid by the petitioner and the complainant alleges that he supplied bricks whereas the petitioner submits that he has already paid the amount and only Rs. 54,000/- is due against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Bagaha, West Champaran in connection with Complaint case No. 01 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
