JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-12-2020 Heard Mr. Nachiketa Jha, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in connection with Mahua P.S. Case No. 403 of 2020, dated 17.07.2020, instituted for the offences under Sections 147, 148, 149, 188, 341, 342, 332, 333, 335, 307, 379, 427, 504 and 506 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that against him, there is only general and omnibus allegation of attacking the police party and damaging the police vehicle. In fact, 19 persons have been named in the
Patna High Court CR. MISC. No.32468 of 2020(2) dt.08-12-2020 2/2 F.I.R. and the accusation extends to about 150 unnamed persons, but without any specific overt act. The petitioner is stated to have been implicated in this case at the instance of one Ranjan Kumar with whom he has land dispute. The petitioner is in custody since 12.08.2019. Considering the facts afore-stated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali (Hajipur) in connection with Mahua P.S. Case No. 403 of 2020.
