This is an application for bail in a case of misuse. Earlier the petitioner was granted bail in a case registered for the offences punishable under Sections 341, 323, 324, 307, 364, 342, 379/34 of the Indian Penal Code and 27 of the Arms Act. The bail bond of the petitioner was cancelled on 17.01.2012. Now the petitioner is in custody since 13.02.2015. There is nothing on the record to suggest that from 2008 to 2012 and since February, 2015 till date any progress has been made in the trial. It is submitted by learned counsel for the petitioner that the petitioner will appear regularly before the learned court below.

No.14611 of 2015 (02) dt.28-04-2015 2/2 Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Madhubani in connection with Sessions Trial No. 344 of 2011 arising out of Jainagar P.S. Case No. 252 of 2008. The learned court below will positively cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
