Learned counsel for the petitioner submits that the petitioner No.2 has been arrested and, therefore, he may be permitted to withdraw this application.

Permission is granted.

Accordingly, this application is dismissed as against petitioner No.2.

So far prayer for bail of petitioner No.1 is concerned, this application arises out of Janki Nagar P.S. Case No.59 of 2021, giving rise to Special Case No.312 of 2021, disclosing offences under Sections 272, 273 of the IPC and Section 30(A)

Patna High Court CR. MISC. No.42838 of 2021(2) dt.10-12-2021 2/2 of Bihar Prohibition and Excise Act, 2016.

In view of the fact that the petitioner No.1 is the wife of petitioner No.2 and it does not seem that she will be involved in selling of illicit liquor, the application for anticipatory bail is allowed.

Let the petitioner No.1, Sarita Roy, in the event of her arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Purnea, in connection with Janki Nagar P.S. Case No.59 of 2021, giving rise to Special Case No.312 of 2021, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
