The present case has been registered on the basis of Complaint Case No.3023 of 2010.
It is submitted on behalf of the petitioner that actually the petitioner had taken the truck in question from the complainant for plying the same, but the truck was not in order. The truck in question was seized on 30.10.2007 itself and thereafter the petitioner could not ply the vehicle on the road so as to occasion payment of monthly rent of the vehicle in question. It is further submitted on behalf of the petitioner that the complainant after a belated period has filed the complaint case only to coerce the petitioner and recover the rent for the said vehicle.

No.46365 of 2014 (3) dt.16-02-2015 2/2 Considering the aforementioned submissions and the fact that the petitioner has been in custody since 14.9.2014 in connection with the present offence and also the fact that he has no criminal antecedents, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Barahariya P.S.
