ANJANA MISHRA ORAL ORDER 18-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 8.6.2014 in Begusarai Muffasil P.S. Case No.210/14 for the offence under Sections 457, 376, 379, 342, 323,504/34 of I.P.C. The accusation against the petitioner is of allegedly committing rape on the prosecutrix. The statement in the F.I.R., however, does not stand supported by her statement made under Section 164 Cr.P.C. Further more, the medical evidence also does not support the commission of rape.

Considering the aforementioned situation and also the fact that the petitioner has been in custody since 8.6.2014 and
