04-02-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in Khagaria Mahila P.S. Case No. 25 of 2014 dated 22.05.2014 instituted under Section 376 of the Indian Penal Code.
Learned counsel for the petitioner submits that he has clean antecedent and the allegation is false and he is in custody since 23.05.2014.
Learned A.P.P. opposes the prayer for bail and submits that in view of the specific allegation made against the petitioner in the F.I.R., he does not deserve indulgence. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, the Court is not inclined to enlarge the petitioner on bail. Accordingly, the application stands dismissed.
