The petitioner is languishing in custody since 17.2.2016 in a case registered for the offence punishable under sections 20, 22 of the N.D.P.S.Act.

From the house of the petitioner 5 Kg. Ganja was recovered.

It is submitted by the learned counsel for the petitioner that no recovery was made from the conscious possession of the petitioner. Statement has been made in paragraph 3 of the application that the petitioner has no criminal antecedent. Mr. Uma Shankar Prasad Singh, learned A.P.P., does not dispute the quantity of recovery from the petitioner. Considering the aforesaid facts and circumstances, let

Patna High Court Cr.Misc. No.22944 of 2016 (3) dt.29-06-2016 the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Begusarai in NDPS P.S.Case No. 3/2015 arising out of Matihani P.S.Case No. 120/2015.
