supplementary affidavit placing on record Pass Book of the petitioner and his wife with the Axis Bank, contained in Annexure-6.

Heard learned counsel for the petitioner and the State.

Petitioner is an accused in a case under Sections 406, 420 of the Penal Code.

It is submitted on behalf of the petitioner that a sum of Rs. 3,60,000/- shall be deposited in the court below within three months from the date of release of the petitioner from jail custody, whereafter the said amount be invested in a fixed deposit. In case petitioner is acquitted in the trial, the amount so deposited as also the

Patna High Court Cr.Misc. No.46414 of 2014 (4) dt.03-03-2015 2/2 interest earned thereon will be refunded to the petitioner, otherwise the same may be appropriated by the State. Petitioner, in the meanwhile, be provisionally released on bail on furnishing bond of Rs. 5,000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Town P.S. Case No. 757/2014. It is, however, made clear that if within 90 days from the date of release, the above mentioned amount is not deposited, petitioner must surrender in the court below.
