JUSTICE RAKESH KUMAR ORAL ORDER 13-07-2016 Heard Mr. Md. Javed Jafar Khan, learned counsel for the petitioners. None appeared on behalf of the State. Two petitioners, who are in custody since 29.01.2016 in Paraiya P.S. Case no.16/2016 registered for the offence under Sections 25(1-b)a/26/35 of the Arms Act, have prayed for grant of bail.

It was submitted by learned counsel for the petitioners that on false accusation, recovery of one country-made pistol and some cartridges were shown to be recovered from the house of petitioner no. 2. Petitioner no. 1 has been made accused in two other cases of trivial nature. So far as petitioner no.2 is concerned, he is having clean antecedent.

Patna High Court Cr.Misc. No.26854 of 2016 (2) dt.13-07-2016 2/2 Keeping in view of nature of accusation and period of custody, let both the petitioners, namely, (i) Sajjan Singh and (ii) Shiv Kumar Singh be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Santosh Kumar Dubey, learned Judicial Magistrate, 1st Class, Gaya in connection with Paraiya P.S. Case no.16/2016.
