JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-07-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Section302 & other minor sections of the Indian Penal Code and under Section-27 of the Arms Act.

Altogether 11 persons including petitioners are named in the first information report. There is allegation against petitioner Nos. 2 & 3 that they exhorted the other accused to assault the informant as well as his other family members and after that, co-accused, Dhanji Singh opened indiscriminate firing causing death of Uday Singh but according to prosecution case itself, at the time of alleged occurrence, petitioners were unarmed

Patna High Court Cr.Misc. No.23692 of 2016 (3) dt.13-07-2016 2/2 because the informant has given details of arms, which were being carried out by other accused at the time of said occurrence. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sasaram (Muffasil) P.S. Case No. 1360 of 2015 corresponding to Sessions Trial No. 103 of 2016 to the satisfaction of Learned Additional District & Sessions Judge-IV, Rohtas at Sasaram.
