JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-03-2015 Petitioner is languishing in custody since 11.11.2013 in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471, 120B of the I.P.C. It is alleged that informant was enquired about his ATM from someone claiming to be of Reserve Bank of India. Subsequently the informant got his mobile connection disconnected when it was got connected again and again by this petitioner. Subsequently the petitioner was arrested and from him forged identity card, SIM and photographs of different persons were recovered.

It is submitted by learned counsel for the petitioner that petitioner works in a mobile shop and even assuming the accusation, no offence under Sections 419, 420 and 120B of the I.P.C is made out against the petitioner. A statement has been made in para 3 of the

Patna High Court Cr.Misc. No.8224 of 2015 (2) dt.12-03-2015 2/2 petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali(Tatarpur) P.S. Case No. 831 of 2014.
