The petitioner is apprehending his arrest in connection with Kajraily P.S. Case No.91 of 2018 registered under Sections 363, 366(A), 120(B) of the Indian Penal Code and Section 8 of POCSO Act, 2012.

Allegation against the petitioner as per FIR is that the minor daughter of the informant had gone to school and she did not return and she is traceless. The informant suspected the petitioner and eight others accused persons for kidnapping her for the purpose of marriage.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he was on duty at the time of occurrence.

Heard learned A.P.P. also who was opposed the

Patna High Court CR. MISC. No.80655 of 2018(3) dt.15-04-2019 2/2 prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above and the fact that girl is still traceless, I am not inclined to grant privilege of anticipatory bail to the petitioner rather he should surrender and make prayer for regular bail.
