The petitioner is apprehending his arrest in connection with Bettiah Mufassil (Manuapul) P.S. Case No.439 of 2018 registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is of recovery of countrymade liquor and 5 litres of illicit liquor has been destroyed.

Submission of learned counsel for the petitioner is that petitioner has been falsely implicated in this case and has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.1742 of 2019(2) dt.01-02-2019 2/2 circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of receipt/ production of a copy of this order, be released on bail upon furnishing bail bond of Rs.25,000/-(Rupees Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah, West Champaran in connection with Bettiah Mufassil (Manuapul) P.S. Case No.439 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
