=========================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 28-09-2016 Heard learned counsel for the parties.
A show cause has been filed on behalf of the petitioner in terms of the order of the Court dated 07.09.2016. At the very outset, learned counsel for the petitioner tenders unconditional and unqualified apology on behalf of the petitioner for disobedience of the order of the Court, inasmuch as, instead of surrendering by 1st April, 2015, pursuant to the provisional bail granted to him, he did not do so leading the Court to direct the Senior Superintendent of Police, Patna to take him into custody. It is further submitted that in the meanwhile, the petitioner has been convicted in the substantive criminal case and the present application for bail has become infructuous.
Patna High Court Cr.Misc. No.46490 of 2014 dt.28-09-2016 2/2 In view of the aforesaid, the Court accepts the apology but issues a strict warning to him that if in future it comes across any conduct of the petitioner, which is in violation of any order of the Court, strict view shall be taken. The application stands disposed off.
