No.448 of 2016, which was dismissed for default, on 29.06.2016.

Heard Mr. Ram Prawesh Kumar, learned Counsel, appearing on behalf of the applicant, and Mr. Roy Shivaji Nath, learned Additional Advocate General No.3, appearing on behalf of the State-respondents.

Having considered the averments made in the application and having heard the learned Counsel for the parties, this Court is satisfied that the absence of the applicant and/or his Counsel from the Court, on 29.06.2016, was for reasons beyond their control.

In view of the above and in the interest of justice, the order, dated 29.06.2016 aforementioned, is hereby set aside

Patna High Court MJC No.2511 of 2016 (2) dt.19-09-2016 2/2 and Cr.W.J.C. No.448 of 2016 aforementioned, is hereby restored to its original file.

This Miscellaneous Case shall, accordingly, stand disposed of.
