This is an application of bail in a case of misuse. Initially the petitioner was granted bail in a case registered for the offences punishable under Sections 147, 148, 149, 323, 447, 302 of the Indian Penal Code and 27 of the Arms Act. The bail bond of the petitioner was cancelled in 2010 and now the petitioner is in custody since 01.02.2014. It is submitted by learned counsel for the petitioner that the petitioner undertakes to appear regularly before the learned court below. There is nothing on the record, particularly impugned order of the learned Sessions Judge, to suggest that any progress of trial has been made after petitioner went into custody.
Patna High Court Cr.Misc. No.12106 of 2015 (02) dt.30-03-2015 2/2 Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Munger in connection with Sessions Trial No. 479 of 2004 arising out of Tarapur P.S. Case No. 178 of 2000.
The learned court below will positively cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
