JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 22-09-2022 Learned counsel for the petitioner submits that in this case, the I.O. has submitted a final form but disagreeing with the same, the learned court below has taken cognizance and issued summons to the accused persons.

Learned counsel submits that for neglecting the investigation of the present case, the I.O. of the case has been suspended by D.I.G., Eastern region, Bhagalpur. It is his submission that in fact the I.O. has not collected the entire materials in course of investigation and has ensured that the accused gets benefit of the same. He is looking for

In the given facts and circumstances of the case, this writ application is being disposed of giving liberty to the petitioner to submit an apropriate application with all supporting materials to the D.I.G., Eastern Region, Bhagalpur requesting him to look into his grievance and take steps towards further investigation of the case. The D.I.G. Eastern Region, Bhagalpur shall examine the entire materials and in case, it is found that the case requires further investigation, he will take steps for the same.

So far as the prayer for taking action against the I.O. is concerned, the same shall also be looked into by the D.I.G., Eastern Region, Bhagalpur who is said to have placed him under suspension and a departmental proceeding is said to have been initiated against him. The same should be taken to a logical end.
