JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in jail custody since 26.06.2014 in a case registered under Sections 342 and 302/34 of the Indian Penal Code on the accusation that he forcibly made the deceased to sit in a Tempo and thereafter, he alongwith the deceased proceeded somewhere else and later on, dead body of the deceased was recovered.
In course of investigation, the witnesses have stated the above stated facts and the wife of the deceased stated that the petitioner had taken Rs. 1,00,000/- as loan from the deceased and with an intent to digest the aforesaid amount, he committed murder of her husband. Even if the statement of the witnesses

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya, in connection with Fatehpur P.S.
