This application for anticipatory bail arises out of Baheri P.S. Case N0. 204 of 2017, disclosing offences under Sections 363,366A/34 of the Indian Penal Code. Considering the fact that the victim has made specific allegation against the petitioner in her statement recorded under Section 164 of the Code of Criminal Procedure as also the fact that the bail application filed on behalf of co-accused Chandrajeet Mukhiya has been rejected, I am not inclined to grant the petitioner anticipatory bail.

This application is, accordingly, rejected.

However, the petitioner is directed to surrender before the Court below within four weeks from today and seeks regular

Patna High Court Cr.Misc. No.80398 of 2018(2) dt.25-01-2019 2/2 bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of the present application for grant of anticipatory bail.
