JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-05-2019 Petitioner seeks regular bail in connection with Sessions Trial No.549 of 2018 arising out of Jadopur P.S. Case No.38 of 2018 registered for the offences punishable under Sections 302 & 34 of the Indian Penal Code.

There is specific allegation against the petitioner is of stabbing the son of the informant, causing death. Submission of the learned counsel for the petitioner is that he is in custody for more than a year and charge sheet has already been submitted as such, there is no chance of tampering with the evidence.

Heard learned A.P.P. also, who has opposed the prayer for bail.

Having heard both sides, in view of the facts and circumstances, as stated above and the allegation levelled

Patna High Court CR. MISC. No.33494 of 2019(2) dt.22-05-2019 2/2 against the petitioner, I am not inclined to grant bail to the petitioner. However, as the petitioner is in custody for more than a year, the learned trial court is directed to expedite the trial of this case.

With the above observations, this application is dismissed.
