The petitioner seeks bail in Marauna P.S. Case No. 08 of 2014, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.

The informant alleged that the petitioner Santosh Kumar Sah, Pawan Sah and Domi Mandal along with 3-4 unknown persons tried to drag his nephew Janardan Prasad and in the meantime Pawan Sah made indiscriminate firing in which Janardan Prasad got injuries and died.

Learned counsel for the petitioner submits that no specific allegation is made against the petitioner Santosh Kumar Sah. Similarly situated co-accused Domi Mandal has already been

Patna High Court Cr.Misc. No.9400 of 2015 (3) dt.02-04-2015 2/2 enlarged on bail vide order passed in Cr. Misc. No. 33168 of 2014 on 23.01.2015.

Considering the facts aforesaid that allegation of firing is made against Pawan Sah and case of the petitioner Santosh Kumar Sah is similar to that of Domi Mandal the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Supaul in connection with Marauna P.S. Case No. 08 of 2014.
