2. In this case, the petitioner is seeking regular bail in connection with Chapra Town P.S. Case No. 13 of 2022, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307 of the Indian Penal Code & Section 27 of the Arms Act.
3. As per allegation, 15 named accused persons including the petitioner badly assaulted the son of the informant.
4. Learned counsel for the petitioner submits that the allegation against the petitioner is general and omnibus and on similar footing co-accused persons have been granted bail in Cr. Misc. Nos. 40887 of 2022, 22663 of 2023 and 34433 of 2022. He further submits that the petitioner is under custody since 7.11.2023.
5. Considering the above-mentioned facts and
Patna High Court CR. MISC. No.37055 of 2024(2) dt.17-05-2024 2/2 circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town P.S. Case No. 13 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. (ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
