The petitioner apprehends his arrest in a case registered for the offence under Sections 447, 341, 323, 380, 504/34 of the Indian Penal Code and Section 8 of POCSO Act. As per F.I.R., on 28.11.2021, while the daughter-inlaw and grand daughter of the informant were alone at home, this petitioner came there and started misbehaving with them and on alarm, when informant went to save them, this petitioner assaulted her with iron rod, due to which, she received head injury.

It is submitted on behalf of petitioner that petitioner is none else but own son of the informant and due to property dispute, simple Maarpit took place. From perusal of injury report, it appears that the injury, sustained by the informant, is

No case under the POCSO Act is made out against this petitioner, since doctor has assessed the age of victim (grand daughter of informant) between 17-19 years. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court POCSO cum Addl. Sessions Judge - VI, Vaishali at Hajipur in connection with Mahnar P.S. Case No. 360 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
