2. A prayer for bail has been made on behalf of the petitioner in connection with Kishanganj P.S. Case No.521 of 2023 registered for the offence under section 21(b), 8(c) and 29 of the NDPS Act.

3. The allegation in the F.I.R is with regard to recovery of 53.900 grams of smack from the jacket of accused Md. Abdul Salam @ Akhtar.

4. It is submitted by learned counsel for the petitioner that the petitioner was granted privilege of anticipatory bail vide order dated 20.03.2024 passed in Cr. Misc. No. 17096 of 2024 (Annexure-1) to the petition on the thrust of the allegation against Md. Abdul Salam@ Akhtar but since the petitioner

Patna High Court CR. MISC. No.32329 of 2025(2) dt.20-05-2025 2/2 could not fulfill the condition imposed by the said order and therefore, he was unable to furnish the bail bonds. The petitioner has no criminal antecedent and undertakes to co-operate in the case/trial.

5. The application for bail is opposed by learned APP for the State.

6.Taking into consideration the fact that the recovery of smack is admittedly from the jacket of co-accused Md. Abdul Salman @ Akhtar who has already been granted bail vide order dated 31.01.2025 passed in Cr. Misc. No. 76858 of 2024, a copy of which has been annexed as Annexure-3 to the petition, the petitioner is directed to be enlarged on bail in connection with Kishanganj P.S. Case No.521 of 2023 on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-cum-Special Judge, NDPS, Kishanganj.
