JUSTICE AMARESH KUMAR LAL ORAL ORDER 12-02-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case for the offence punishable under Section 414/34 of the Indian Penal Code and Sections 22/24 N.D.P.S Act.

The allegation is that on the raid made by Sasastra Seema Bal, three miscreants including the petitioner were apprehended and a bag was found in possession of Sk. Samashed in which different kinds of drugs were there.

It is submitted that nothing has been recovered from the possession of the petitioner nor he was using the drugs. The drugs and seized motorcycle do not belong to the petitioner. Nothing has been recovered from the possession of the petitioner and he has no

Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two genuine sureties of the like amount each to the satisfaction of the learned Sessions Judge/Special Judge, East Champaran, Motihari in N.D.P.S. Case no. 81 of 2014 arising out of Raxaul P. S. Case no. 304 of 2014 with the following conditions :

1. The petitioner will not indulge in similar or in any other offence.

2.

The petitioner will be well represented in the court.

3. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned. (Amaresh Kumar Lal, J) sudip/- U T
