The petitioner apprehends her arrest in connection with Manigachi P.S. Case No. 166 of 2018 (G.R. No. 36 of 2018) for the offence punishable under Sections 376, 341, 323, 506, 315 and 34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any office. In fact, there is general and omnibus allegation against the petitioner whereas the specific allegation is attributed to Md. Basir, who happens to be cousin of the informant and son of the petitioner. Moreover, no observation with respect to
Patna High Court CR. MISC. No.77456 of 2018(4) dt.13-03-2019 2/2 abortion has been found in the medical report of the informant, which is evident form Annexure-2. Hence, the petitioner, who is a innocent lady, may be granted the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the, above named, petitioner in the event of surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge -cum- Special Judge, (POCSO Act), Darbhanga in connection with Manigachi P.S. Case No. 166 of 2018 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
