2. The petitioner apprehends his arrest in connection with Nalanda Cyber P.S. Case No. 11 of 2025, registered for the offences punishable under Sections 316(2), 319(2), 318(4), 303(2), 336(3), 338, 340(2), 61(2) of the BNS, 2023 and 66, 66(C), 66(D) of I.T. Act, 2000.

3. As per allegation, having received the information some cyber criminals were assembled, the police raided the place of occurrence from where, co-accused Amit Raj @ Murari Kumar was arrested. Three mobile sets were recovered from possession of coaccused Amit Raj @ Murari Kumar. It has also been mentioned in the FIR that evidence of money transaction was found. The apprehended co-accused person disclosed the complicity of the petitioner in the

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. No incriminating article has been recovered from possession of the petitioner and his name has been transpired in this case on the basis of confessional statement of co-accused, Amit Raj @ Murari Kumar. Except confessional statement of co-accused, there is nothing against the petitioner to show his involvement in the present case. It has further been submitted that main co-accused, Amit Raj @ Murari Kumar has been granted bail by learned Court below itself. The petitioner is a person of clean antecedent.

5. On the other hand, learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif in connection with Nalanda Cyber P.S. Case No. 11 of 2025, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023 with further following conditions: (i) The petitioner shall co-operate with the trial and make himself available as and when required by the Court.

(iii) The learned Court below shall verify the criminal antecedent of the petitioner, and if it is found that the petitioner is involved in any other criminal case, except the present one, his bail bond shall stand cancelled.
