JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 This application, for grant of anticipatory bail, arises out of Murar P.S. Case No. 10 of 2018, disclosing offences under Sections 30 (a) of Bihar Prohibition and Excise Act, 2016.

Allegation as per F.I.R is that while the police was engaged in vehicle checking, one person, who was riding on the motorcycle took u - turn after seeing the police party and fled away, however, on bag fallen down from which, 3 litres and 600 M.L. liquor has been recovered.

Submission of learned counsel for the petitioner is that he is not named in the F.I.R. and has no criminal antecedent and has falsely been roped in the present case. Heard learned A.P.P. also.

Having heard both sides, considering the quantity of

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - cum- Special Judge, Excise Act, Buxar, in connection with Murar P.S. Case No. 10 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure (Vinod Kumar Sinha, J) sunilkumar/- U T
