JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case under sections 328 and 379 of the Indian Penal Code.

It is alleged that during investigation one Birendra Sah confessed that he drugged passengers in the train and used to escape with their belongings. Accused Birendra Sah in his confessional statement named one Surendra Sah and Rafi Mian, pursuant to which some stolen goods were recovered from the house of Rafi Mian. The aforesaid Rafi Mian has been allowed bail.

Learned counsel for the petitioner submits that he has been implicated in this case as he is brother of Rafi Mian and lived in the same house.

Considering the facts and circumstances of the case, the

Patna High Court Cr.Misc. No.47390 of 2014 (2) dt.03-03-2015 petitioner Sabir Alam is directed to be released on bail in connection with Narkatiaganj Rail P.S. Case No.9 of 2014 on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Bettiah.
