The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 188, 327 of the Indian Penal Code.

It is alleged against the petitioners that they encroached the government land and made construction over the said land.

It is submitted by learned counsel for the petitioners that petitioners have falsely been implicated in this case. The petitioners are residing over the land in

Patna High Court CR. MISC. No.35742 of 2022(2) dt.29-11-2022 2/2 question since last several years and the electricity connection and ration card are also in the name of the petitioners. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 3rd, Katihar in connection with Barari P.S. Case No. 212 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
