JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-03-2015 Petitioner is languishing in custody since 02.01.2015 in a case registered for the offences punishable under Sections 147, 148, 149, 302, 307 of the I.P.C. and Section 27 of the Arms Act.
It is alleged that ten unknown miscreants fired on the back of the father of the informant. Subsequently father of the informant succumbed to the injuries. The First Information Report was registered against unknown.
Subsequently the name of the petitioner transpired during investigation.
It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled and similarly situated co-accused has been granted bail vide Cr. Misc. No. 35034 of 2013.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.12908 of 2015 (2) dt.31-03-2015 2/2 petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Akbarnagar P.S. Case No. 53 of 2012(G.R. No. 2269/A/12).
