JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections457 and 380 of the Indian Penal Code. In course of investigation, one co-accused Laltush Choudhary was arrested who disclosed the name of the petitioner. Some stolen articles are said to have been recovered from the house of co-accused Laltush Choudhary. Subsequently, the house of the petitioner was also raided and some articles and other things were recovered from his house.

The prosecution claims that the ornaments and articles seized from the house of the petitioner are stolen property of the

Patna High Court Cr.Misc. No.24331 of 2016 (3) dt.15-07-2016 2/2 present case but there is nothing on record to show that the recovered articles were ever produced on T.I. Parade. Moreover, petitioner claims that he is a Goldsmith and recovered articles belong to him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S. Case No.17 of 2016.
