During course of investigation of Chakiya PS. Case No.

111/2013 wherein Jitendra Kumar Upadhyaya was apprehended who, during course of interrogation shown complicity of Babloo Dubey (petitioner) and further his presence at Baans Ghat. A raid was conducted at the house of Deepak wherefrom Deepak as well as Sagar Raj Singh Chauhan were apprehended. On search, from possession of Sagar Raj Singh Chauhan, mobile set having double SIM was seized. On query, they both have disclosed that Babloo Pandey was there, had gone to his relative. He had also taken away Rs. 2 Lakh which they had obtained by way of Rangdari.

No.48072 of 2014 (2) dt.03-03-2015 From the order impugned, it is evident that save and except criminal antecedent nothing substantial has been collected by the Investigating Officer during course of investigation. Furthermore, petitioner is under custody since 24.06.13 and on account thereof, petitioner, Babloo Dubey @ Mithilesh Dubey is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri S.K. Mishra, Judicial Magistrate 1st Class, East Champaran at Motihari in connection with Chakiya P.S. Case No. 115/2013.
