JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-07-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner no. 1 is said to have hurled bomb causing injuries to the informant due to petty dispute. So far as petitioner no. 2 is concerned, he was also present along with petitioner no. 1 and others at the time of alleged occurrence. Submission on behalf of the petitioners is that the alleged occurrence took place on the occasion of Holi festival but, subsequently, parties have compromised this case as they are neighbours. It is submitted that no doubt, multiple injuries, 12 in number, were found in the abdomen of the injured and injured was referred to hospital for better treatment but even after submission
Patna High Court Cr.Misc. No.24357 of 2016 (3) dt.15-07-2016 2/2 of the charge sheet, the I.O failed to obtain the complete injuries report as opinion regarding the injuries had been kept reserved. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioners do not have any criminal antecedent and they are languishing in jail custody since 24.03.2016, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Banka ( Barahat) P.S.Case No. 164 of 2016.
