JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-04-2019 This is an application for grant of anticipatory bail in connection with Amnaur P.S. Case No. 189 of 2017, disclosing offences under Sections 188, 272, 273, 420, 120(B) of the Indian Penal Code and Sections 30(a), 38, 41 of the Bihar Prohibition and Excise Act, 2016.
Allegation as per F.I.R. is of recovery of huge quantity of liquor from the truck of the petitioner and in the F.I.R. it has also comes that the petitioner happens to be the owner of the said truck.
Submission of learned counsel for the petitioner is that he has given the truck to the transporter and he has nothing to do with the seized article and he has falsely been implicated in this case and having no criminal antecedent. Heard learned A.P.P. also.

No.80746 of 2018(4) dt.16-04-2019 2/2 Having heard both sides, in view of the facts and circumstances of the case, this application is disposed of with a direction to the petitioner to surrender before the court below within a period of six weeks and make prayer for regular bail and produce the paper showing that he had handed over the said truck to the transporter for carrying articles and after considering the aforesaid submission and verifying the documents, the learned court below shall pass an appropriate order, if possible, to be disposed of on the same day.
